August Question of Month

Question: As part of the Fair Labor Standards Act (FLSA), The Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act of 2022 requires employers to support breastfeeding employees by providing:

a. Reasonable break time to express breast milk for 1 year after your child's birth.

b. Certain employee's airlines, railroads, and motorcoach carriers with pump at work protections.

c. Clean, private space that is not a bathroom to express breast milk.

d. Both a and c.

e. None of the above.

Correct answer: D.

The PUMP Act requires employers to provide reasonable break time for an employee to express breast milk for their nursing child for one year after the child's birth each time such employee has need to express the milk. Employees are entitled to a place to pump at work, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public.
